In Can I Trademark it?    -  updated on 4/20/2017
I run a private cooking business and have for over 10 years. Someone else who sells a product has chosen my business name and trademarked it. I don't need to trade mark myself, I just want to avoid any legal repercussions, as they have asked me to cease using my name.

In Can I Trademark it?    -  updated on 4/11/2017
Hi. I have not released the app yet but have spent money in terms of design, marketing, logo, etc.,... And unfortunately I found out that the name is already trademarked by another company. The company is in a completely different industry and has no relevance to my app. The company specializes in "Cases for eyeglasses and sunglasses" while my app specializes in mobile social networks. Is it safe to continue using the name? Or should I change it now despite my investment? Thanks, Semih

I am a cartoonist who puts his toons on products at print-on-demand sites such as Zazzle. One of the designs I did in 2009 featured an original cartoon of a heart pumping iron with a dumbell and a slogan, "Get Fit - Stay Fit!" (https://www.zazzle.com/motivational_heart_fitness_cartoon_gym_poster-228667178814789182) I added a copyright symbol and my name as part of the design. Today, I found that a company in Canada (http://cordarofit.com/) is using the same phrase together with their company ...

Are pre-1923 images with expired/canceled trademarks in the public domain?

In Expired Trademarks    -  updated on 2/20/2017
I've seen repeated questions about re-using pre-1923 advertising, where the respondent warns about trademarks (and trademarked phrasing) appearing, but I've yet to see anyone discuss the situation where, yes, there is a trademark, but the trademark is canceled or expired. The particular case I'm looking at has two trademark images I'd like to use: one says "Section 8 - canceled - 2002," and the other, "Expired - 1989." I'm not interested in *acquiring* the trademark; I'd merely like to reprod...
